FCRA compliance

How this check stays compliant.

Built to be defensible: upfront consent, adverse-action support, and open dispute rights.

  • Atlas is the reporting agency; you decide

Atlas is a Consumer Reporting Agency that furnishes reports under the FCRA. Your organization makes the hiring decision.

  • Consent before every check

Every check needs a lawful permissible purpose, a standalone disclosure, and the applicant's written authorization.

  • A supported, two-step adverse action

Pre-adverse notice with the report and a summary of rights, a waiting period, then a final notice. Atlas supports each step.

  • Disputes are reinvestigated

Applicants may dispute a report; Atlas reinvestigates and corrections reach your dashboard. Email compliance@atlasscreening.com.

  • Sourced with reasonable procedures

Contents come from third-party and public records. Atlas uses reasonable procedures for accuracy but cannot guarantee every record is current.

MVR questions.

State coverage, CDL handling, and how continuous monitoring keeps your fleet compliant after hire.

Which states are covered?
All 50 state DMVs plus DC are covered. Return time varies by state. Most are instant, and the handful of manual-request states typically return within 24 hours.
How far back does the driving record go?
The reporting window depends on state law. Most states return three to seven years of driving history; commercial CDL records can extend further where federal regulations require it.
Do you handle CDL and DOT compliance?
Yes. Atlas surfaces endorsements, medical certifications, and restrictions required for CDL roles, and our report format is structured for DOT audits and FMCSA compliance reviews.
What is continuous monitoring?
After a driver is hired, Atlas can monitor their record continuously. When a new violation, suspension, accident, or status change is reported, you receive an instant alert in the dashboard and by email.
Is applicant consent required?
Yes. Pulling a motor vehicle record is a consumer report under the FCRA, so explicit, written consent is required. Atlas collects and stores timestamped consent as part of the applicant flow.
